Court of Tocantins overturn censorship on 84 newspapers, websites and radio & TV stations

Three days after instituting censorship to 84 means of mass communication in Tocantins, Justice overturned the preliminary injunction granted to the alliance Força do Povo, of  the candidate for reelection to the government, Carlos Gaguim (PMDB). The request was signed by the same alliance.

On Friday, 24th, the judge Liberato Póvoa, from the Regional Electoral Court of Tocantins (TRE-TO), had prohibited the publication of information concerning the investigation about deceptions in public procurements where the governor was mentioned. However, the TRE-TO overturned the decision setting free eight newspapers, 11 televisions channels, 5 sites, 40 community radio stations and 20 commercial radio stations.

The prohibition had been requested by the alliance formed by 11 parties, including PT, that supports Gaguim. The preliminary injunction establishes a daily penalty of $ 6,000 in case of disobedience.

On Monday morning, Gaguim’s lawyers requested a repeal to the TRE-TO. The candidate asked the restrictions to be applied only to the electoral advertisements on radio and TV, setting free the enterprises. The TRE overturned the preliminary injunction on this Monday by 4 votes to 2.
